Terms of Use for Allied Health Services through the Nourished Not Deprived Platform: Client Informed Consent Form

Allied Health Services:

As part of providing linking to allied health care providers, Nourished Not Deprived and your linked practitioner need to collect and record personal information from you that is relevant to your situation, such as your name, contact information, medical history, and other relevant information. This collection of personal information will be a necessary part of the assessments and treatment that is conducted. You do not have to give all personal information, but if you don’t, this may mean the allied health service may not be able to be provided to you.

Telehealth Consultation Overview

During a telehealth consultation, your therapist will:

– Assess your needs and therapy-related goals.
– Offer information and recommendations as appropriate.
– Provide details on how telehealth will be tailored to your unique circumstances.

Face-to-Face Consultation Overview

During a face-to-face consultation, your therapist will:

– Assess your needs and therapy-related goals.
– Offer information and recommendations, as appropriate.
– Provide details on how face-to-face consultations will be conducted.

By signing this agreement, you acknowledge and accept the following:

– You are responsible for the costs associated with setting up the necessary technology for accessing telehealth services, including an appropriate device (e.g., smartphone, laptop, iPad, computer) with a camera, microphone, and speakers, as well as a reliable internet connection.
– Nourished Not Deprived Pty Ltd will cover the costs of calls to you and the platform used for telehealth services.
– You are required to access a quiet and private space for telehealth consultations.
– You may include a support person in your telehealth session, similar to a face-to-face consultation.
– Video or audio recording of the session is not permitted without your therapist’s permission.
– Telehealth involves the transmission of medical and mental health information over the internet or telephone connection.
– Telehealth sessions serve the same purpose as in-person psychological treatment but may be experienced differently due to technology use.

By signing this agreement, you also acknowledge the following regarding face-to-face consultations:

– You are responsible for arranging transportation to and from the therapy location.
– Face-to-face consultations may be conducted in a clinic, office, or other agreed-upon location.

Engagement at Own Risk: The patient acknowledges and agrees that engaging with the contracted clinicians provided by Nourished Not Deprived is undertaken at their own risk. Nourished Not Deprived shall not be held liable for any outcomes, damages, or disputes arising from the patient’s interactions or engagements with the contracted clinicians.

Independent Contractors: The contracted clinicians providing services through Nourished Not Deprived are independent contractors. Any services rendered by these clinicians are provided solely on their own behalf and do not constitute an employment relationship with Nourished Not Deprived. Therefore, Nourished Not Deprived disclaims any responsibility for the actions, conduct, or professional advice provided by these contracted clinicians.

No Liability: Nourished Not Deprived shall not be liable for any loss, injury, or damage arising directly or indirectly from the patient’s interactions with the contracted clinicians, including but not limited to any advice, diagnosis, treatment, or services provided by them. The patient assumes all risks associated with such interactions. Nourished Not Deprived will assist in risk management to the best of its ability.

Professional Responsibility: The patient acknowledges that the contracted clinicians are solely responsible for the professional services they provide, including adherence to ethical standards, professional guidelines, and legal obligations. Nourished Not Deprived does not exercise control or supervision over these clinicians’ clinical judgment or actions from an employee-employer relationship.

Indemnification: The patient agrees to indemnify, defend, and hold harmless Nourished Not Deprived, its officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, costs, or expenses (including legal fees) arising out of or related to the patient’s interactions with the contracted clinicians.

These clauses aim to clarify the patient’s responsibility and Nourished Not Deprived’s liability limitations regarding their engagement with contracted clinicians.

Risks of Telehealth

Despite our efforts to maintain secure end-to-end encryption for telehealth conferencing, there are potential risks, including:

– Technical failures that could disrupt or distort telehealth sessions.
– The possibility of unauthorized access to or interruption of telehealth sessions.
– The risk of sessions being overheard by others, necessitating a private, well-lit, and distraction-free location.
– Your agreement to adhere to the telehealth service’s terms of service.

Risks of Face-to-Face Consultations

Despite our efforts to provide a safe and secure environment for face-to-face consultations, there are potential risks, including:

– Exposure to infectious diseases, including COVID-19.
– Transportation-related accidents or incidents.
– Interruptions or disturbances at the therapy location.

Potential Benefits of Telehealth

Telehealth may offer the following advantages:

– Improved access to therapy services.
– Reduced travel requirements.
– Lower exposure to infectious diseases.

Potential Benefits of Face-to-Face Consultations

Face-to-face consultations may offer the following advantages:

– Direct interaction with your therapist.
– Personalised care and attention.
– Immediate feedback and rapport building.

Will My Privacy Be Protected?

Nourished Not Deprived Pty Ltd is bound by the Privacy Act 1988, ensuring the collection, use, and disclosure of personal information comply with legal obligations, including those related to telehealth.

Your therapist must uphold confidentiality and privacy standards during sessions and in the creation, storage, and transmission of records. While audio and video recordings may be made to support the therapist’s work, your therapist will seek your consent before recording.

You must be provided with details regarding the management of your personal information, access to it, and avenues for lodging concerns or complaints upon request.

However, email communication is not secure for transmitting personal information.

Informed Consent

Informed consent entails several essential principles:

– You must receive relevant information, so please feel free to ask your therapist any questions about telehealth and the services offered.
– You have the right to comprehend the provided information, and your therapist will clarify any uncertainties.
– You have the freedom to choose; if you disagree with the therapy process, you can refuse participation or agree to specific activities within sessions.
– You can discontinue services at any time, even during a session.
– You can provide consent verbally or in writing, with verbal agreements documented by your therapist.
– You may enquire about alternatives to telehealth, as your therapist will explore potential options with you.

Nourished Not Deprived Disclaimer

Nourished Not Deprived hereby disclaims any responsibility for the actions or conduct of the practitioner you are linked with. 

By entering into this agreement and/or by engaging with your chosen practitioner, you acknowledge and accept that you do so at your own risk. Your safety is our priority. Should any concerns arise during your therapy sessions, please promptly contact us. We highly value your feedback and urge you to utilise our complaints portal for addressing any issues. 

Cancellation & Rescheduling Fee Policy

To secure your appointment with Nourished Not Deprived, we require a 50% non-refundable deposit upon booking. If you cancel within 24 hours of your scheduled appointment or fail to attend, the deposit will be converted to a cancellation fee, and you’ll be charged the full consultation fee. Rescheduling within 24 hours of the appointment will also incur a fee equal to 50% of the full cost. These terms apply to all appointments to ensure fairness and consistency.

Please note that for NDIS participants, our cancellation and rescheduling policies may differ in accordance with NDIS policies. You can access the detailed policies through the service agreement provided during onboarding. We prioritise transparency and compliance with legal requirements to ensure a positive experience for all clients. By engaging with us, you confirm your consent to receiving telehealth therapy services and acknowledge our policies and associated risks outlined in our Terms of Use, Privacy Policy, and Consent notices. You retain the right to refuse services at any time.

Mailing List Consent

By signing below, you acknowledge and confirm my consent to be included in the mailing list of Nourished Not Deprived. You understand that this may involve receiving informational and promotional materials related to the services and updates from the practice. You also acknowledge that you have the right to unsubscribe from this mailing list at any time by contacting the practice directly. You understand that my contact information will be used solely for the purpose of communicating relevant information related to the practice and will not be shared with any third parties without your explicit consent.

By entering into this agreement and/or by engaging with your chosen practitioner, you agree to receive therapy services via telehealth or face-to-face practices through Nourished Not Deprived, are aware of our Cancellation and Rescheduling Policies, understand all risks associated with your appointments, and understand that you can refuse services at any time.

Comprehensive Service Acknowledgement and Understanding Statement

By submitting a referral to Nourished Not Deprived, you are affirming your understanding and acceptance of NND’s commitment to maintaining high standards. You acknowledge that NND’s service provides a diverse array of funding and pricing options tailored to accommodate various individual circumstances. It is understood that certain individuals may qualify for funding assistance through our service, subject to specific criteria, while also acknowledging the possibility of not meeting the necessary qualifications. Nonetheless, by engaging with our service and/or submitting a referra, you recognise and agree that the pricing structure is meticulously designed to ensure nationwide accessibility throughout Australia, regardless of individual funding eligibility.

Consent to place a referral

By submitting a referral or engaging in our service, you confirm that all parties have consented to their information being submitted to NND and are aware of the referral placement. You acknowledge and confirm that all provided email addresses may be added to the Nourished Not Deprived mailing list. Recipients will receive updates, newsletters, and relevant information about our services. Opting out is possible at any time by using the unsubscribe link in the emails or contacting the practice directly.
